CHAPTER 1362 REQUIREMENTS

Initial Inspection Requirements
Prior to filing a foreclosing action or accepting a deed in lieu of foreclosure, a foreclosing entity shall inspect residential property to determine if the property is vacant or shows evidence of vacancy:
If the residential property is vacant or show evidence of vacancy the property is deemed abandoned, proceed to Registration Requirements; or
If the residential property is not vacant or does not show evidence of vacancy, the foreclosing entity shall continue to inspect the residential property once every 30 days.

Registration Requirements (If a residential property is vacant or shows evidence of vacancy)
Complete an Abandoned Residential Property Registration Form;
Pay a registration fee of $50;
Pay an inspection fee of $100;
Schedule a City Building Inspector to conduct an exterior and interior inspection of the property;
Repair any violations found during this inspection;
Re-register Abandoned Residential Property as needed (registration is valid for 6 months, if the property is still abandoned after 6 months the foreclosing entity must re-register the property)
Comply with Maintenance Requirements, Security Requirements and Property Management Requirements

Maintenance Requirements (If a residential property is vacant or shows evidence of vacancy)
Maintain grass, shrubs, trees and all other landscaping;
Keep property free from trash, debris, graffiti, etc.; and
Drain pools and spas and keep covered or dry

Security Requirements (If a residential property is vacant or shows evidence of vacancy)
Lock and secure all windows, doors or other openings; and
Replace any broken windows or doors with like materials – no board ups

Property Management Requirements (If a residential property is vacant or shows evidence of vacancy)
Arrange to have a property preservation company perform weekly inspections;
Arrange to have the property preservation company complete written reports of the weekly inspections and forward copies to the City Building Department;
Post a sign on the exterior of the property stating: the foreclosing entity’s name, address, its contact person, the contact person’s telephone and email address; and the property preservation company’s name, address, its contact person, the contact person’s telephone and email address.
Repair any noncompliant items reported by the property preservation company, the City or the public.
